Introduction

Empyrion DC Pte. Ltd., Empyrion DC (Asia) Pte. Ltd., and their respective affiliates and related corporations (collectively “Group”, “us”, “we” or “our”) form a next-generation digital infrastructure platform.

In connection with our businesses, we develop, launch, offer and/or promote various communities, products, services, solutions and/or technologies (collectively “Products & Services”).  We also own or manage various websites, mobile/web applications, social media accounts and digital platforms (collectively “Sites”) to provide our customers with information.

Access to/use of our Sites and/or subscription to our marketing emails are subject to:

(a)  our Terms of Use;

(b)  our Privacy Notice; and

(c)  this Cookie Policy,

(collectively “T&Cs”), which may be reviewed and amended by us from time to time, at our sole and absolute discretion. You are reminded to check our corporate websites on a regular basis to obtain the most updated version. More importantly, please ensure that you have read and understood the T&Cs.  If you do not agree with any provision in the T&Cs, please discontinue your access to/use of our Sites and/or unsubscribe to our marketing emails immediately. Any continued access to/use of our Sites and/or subscription to our marketing emails shall be deemed acceptance of the T&Cs.

Applicability

Our Cookie Policy is governed by Singapore laws. All disputes in connection with the access to/use of our Sites and subscription to our marketing emails shall be subject to the exclusive jurisdiction of the Courts of Singapore.

Our Cookie Policy is written in English. Any translation into another language is provided solely for your convenience, and to the extent there is any conflict between the two, the English version prevails.

To the maximum extent permitted under applicable laws:

(a)  nothing in our T&Cs establishes any joint and several liability on the part of any member of our Group; and

(b)  we shall not be liable for any damages (whether consequential, direct, incidental, indirect, punitive, special or otherwise) arising out of, or in any way connected with matters set out in our T&Cs (including access to / use of our Sites and subscription to our marketing emails);

(c)  if we are found liable for any damages, liabilities owing by us to you under or in connection with the T&Cs shall be capped at no more than S$500 in total for all claims.

The cookies may be used to calculate visitor, session, campaign data and keep track of site usage for the site’s analytics report. These cookies may also store information of how visitors use a website and helps in creating analytics reports of how the site is doing. The data collected including the number visitors, the source where they have come from, and the pages visited in an anonymous form.

Use of cookies and data collected

We may use cookies on our Sites to identify you and your preferences, including detecting your web browser’s multimedia capabilities, tracking promotional advertisements that we have displayed to you, maintaining current login information on secure portions of our Sites and providing a unique identifier to your computer so that we can generate statistics regarding the usage of our Sites. As a result of the above, when you access/use our Sites and/or subscribe to our marketing emails, we, our marketing partners and certain third parties (such as advertising networks, digital advertising partners, and social media platforms) may collect information about your online activities.

From time to time, we may engage third-party ad-buying networks to target our advertisements to users through demographic, interest-based, and contextual means, to help us track the effectiveness of our marketing efforts. The information our advertisement networks may collect on our behalf includes data about your visits to websites that serve our advertisements, such as the websites or advertisements you view and your user activities on the websites. This data collection takes place on our Sites and third-party websites that participate in these advertisement networks. Accordingly, you may see a “cookie banner” on some of our Sites and when you give consent to tracking/targeting/marketing cookies, we and our advertising partners may set advertising cookies on sites you may visit (including our Sites), and these advertising cookies may then be used to show you advertisements about various products and services that you have appeared to show interests in.

For avoidance of doubt, any collection, storage, processing, transfer, and/or retention of personal data which may be collected as a result of the use of cookies shall be governed by terms set out in our Privacy Notice. 

Managing and disabling cookies

You can manage your cookie preferences and withdraw your consent anytime anywhere by changing the settings on our Sites.  Notwithstanding the foregoing, we note that most browsers automatically accept cookies. As such, you may choose to modify your browser settings to update your preference in terms of cookies. Please refer to each web browser’s guide and/or other online resources for more information on how to manage, reject or delete cookies.

Notwithstanding the above, kindly note that we cannot technically control the installation of third-party cookies, third-party social media cookies and other identifiers, our references to these cookies and their tracking systems installed by third parties in this Cookie Policy are for reference only. You should consult each relevant privacy policy and/or cookie policy of the respective third-party services so as to obtain full and complete information, given the objective complexity surrounding the identification of technologies based on cookies and other technologies pertaining identifiers.

Similarly, we cannot technically manage the cookie setting in shared computing terminal or device that is used to access our Sites.  Please always check the prior cookies setting at any shared terminal or device you intend to use, and (re)configure accordingly to your own preference.
